ECSA/ICS/INTERTANKO JOINT SUBMISSION ON THE EUROPEAN COMMISSION ENVIRONMENTAL LIABILITY WORKING PAPER

The European Community Community Shipowners’ Associations (ECSA), the International Chamber of Shipping (ICS) and INTERTANKO have jointly submitted comments to the European Commission, in which they expressed the view that environmental damage resulting from shipping should be excluded from the DG Environment Working Paper – Prevention and Restoration of Significant Environmental Damage (Environmental Liability). They pointed out that specialist international instruments had been developed over the years under the auspices of the IMO and IOPC Fund. Liability for environmental damage resulting from shipping activities was governed by the 1992 Civil Liability and Fund Conventions and, soon, the Hazardous and Noxious Substances and Bunker Spills Conventions. In addition, the international Conventions on Limitation of Liability for Maritime Claims (1976 and, soon, 1996) regulated the limits of liability for any remaining environmental damage which were not covered by the specific Conventions.
