Tanker Chartering Seminar held in Singapore

On 27 March 2006, INTERTANKO held Tanker Chartering Seminar kindly hosted by the Singaporean law firm Rajah & Tann, one of our associate members. Organised by the Association's Documentary Committee, the seminar featured experts on chartering law and practice drawn from Singapore, the United Kingdom, and the United States. Chairing the seminar was Mr Arve Ustgård of Teekay Norway.

The Association's General Counsel, John Fawcett-Ellis opened the seminar, following which sessions were led by Prof. Martin Davies, Tulane Law School; Bill Honan, Holland & Knight LLP; Tean Lim, Rajah & Tann; and Rajeev Philip, Steamship Mutual Management Services Ltd. The morning sessions focused on recent developments in chartering law in New York; bills of ladings/letters of indemnities; new chartering forms and clauses as well as important recent case law.

Presentations, which are available on the INTERTANKO web site at, included:

Bills of Lading: Indemnities and Bank Guaranteesby Prof Martin Davies, Tulane Maritime LawCenter;
What is new in New York? By William J. Honan, Holland & Knight LLP;
A review of some recent changes in tanker chartering law and practiceby Tim Lean, Rajah & Tann;
Eyes wide open – recent developments in tanker voyage chartering by Rajeev Philip, Steamship Mutual Management Services Ltd.

The afternoon session featured case studies run as mock arbitrations that illustrated a number of key issues that have recently been before the courts. The issues were the right to make deductions from hire payments and anti-technicality clauses; and calculation of damages in the event of a wrongful repudiation of a time charter. The case studies were extremely effective and participants enjoyed debating the issues involved.

Our thanks go to the hosts for the day, Rajah & Tann and the team of speakers for ensuring a seminar of the highest caliber.
