INTERTANKO/INTERCARGO lunchtime seminar 30 June 'Negligence or Incompetence'

The next seminar for UK-based INTERCARGO and INTERTANKO Members is scheduled for Tuesday, 30 June 2009 at our combined offices in the Minories.


We are very pleased to announce that Ian MacLean, Senior Associate, Ince & Co, will be speaking on "Negligence or Incompetence".


As a lead auditor and master mariner with twelve years of seagoing experience, and six years' senior management experience with a major shipmanager prior to qualifying as a lawyer, MacLean will address the approach of the courts in determining whether a loss has arisen from negligence, (in which case the carrier may have a defence to a claim brought by cargo interests), or a failure to provide competent crew, (where the carrier may be unable to defend against a claim brought by cargo interests).

The session will also look at the practical and easy procedures that can be adopted to assist in persuading a court that the crew are competent, addressing in particular the steps that should be part of the vessel management regime, with an emphasis on the value of having appropriate procedures in place prior to an event which gives rise to a cargo claim.

Time: 1200-1400 (arrivals 1200 for 1215 start of presentation, followed by questions and a sandwich lunch)
